How is workers' compensation treated in asset division?

26521242_S.jpgOne of the key considerations in any divorce is how to ascertain what assets belong to the marriage and which ones are separate assets. This often depends on when the asset was acquired by one of the spouses. In this regard, a question that comes up on occasion concerns assets such as sums of money that one spouse becomes entitled to during the marriage but which pay out after the spouses separate. This can occur in situations involving workers' compensation benefits.

When a new relationship terminates maintenance

One exception is if the couple agrees otherwise, and that agreement is made an order of the court. Another exception is if the recipient spouse is in a domestic partnership, as opposed to a legal marriage.

The parent who does not have custody of the child must pay a certain amount, as stated by the court, to the custodial parent. Generally, this amount is based on each parent's income, with the goal to leave neither is poverty. However, when the paying parent is incarcerated, it can be difficult, if not impossible, to still collect child support.
