My spouse wants a divorce, but I do not. What can I do?

19426905_S.jpgIf your spouse filed for divorce against your wishes, you still have options. Missouri is a no-fault divorce state. This means that a spouse does not have to prove some fault or misconduct on the part of the other spouse in order get a divorce. Rather, a court need only find that a marriage was irretrievably broken in order to grant a divorce. However, you can challenge whether the marriage is indeed over.

How to get a marriage annulled

8164886_S.jpgAn annulment is a procedure by which a marriage is declared invalid under the law. It is different from a divorce, in which a valid marriage is ended. When a marriage is annulled, it is as if the marriage never even happened if the first place.

DNA paternity testing

32378066_S.jpgWhen a man or mother has doubts or suspicions that a man is the father of a child, bitter custody battles often ensue. To determine the truth, paternity tests are ordered. These tests take a close look at the biological makeup, or DNA, of both the child and the other individual. DNA is totally unique and cannot be replicated. The likelihood of paternity that is generated from the comparison is extremely accurate.

Who gets custody during a divorce?

6128608_S.jpgIn Missouri, child custody laws are rather straightforward. Once an arrangement is reached, it must be maintained by both parents. This includes legal and physical custody, as well as any visitation rights. As you may well know, a custody dispute can be one of the most difficult parts of a divorce.

Why establish paternity?

22783592_S.jpgPaternity is the establishment of a child's legal father. It is important -- especially for unmarried couples -- to establish this status because in general, a child is not considered to have a father if the couple is not married. There are many reasons why you should make sure this process is undertaken, not the least of which is protecting your paternal rights.
