Paternal grandmother seeks child custody after mother is jailed

On behalf of Stange Law Firm, PC posted in Child Custody on Monday, March 7, 2016.

Domestic problems involving children often evoke strong emotions from both sides of an issue. In some situations, Missouri grandparents have sought child custody when they believe that a child is not safe in a current environment. A recent incident involved a young out-of-state mother who is now in jail, and her child’s paternal grandmother who has asked the court to let the child live with her.

The child in question is a 2-year-old boy. At this time, he is residing in a foster care home. His biological father’s name is apparently not on his birth certificate, which is why, according to the grandmother, his dad has not sought custody. The boy’s mother was reportedly arrested after a video went viral that included film of the toddler screaming and crying near his mother, who was allegedly high on drugs at the time.

A second video apparently exists that shows the mother kicking her child. The judge who reviewed the case refused to set bond. It seems the woman was already on probation and facing these new charges places her in violation. Charges against her include reckless endangerment and domestic violence.

The boy’s paternal grandmother says she is now battling for child custody. She is also said to have been the one who brought a video to the attention of a caseworker. Unfortunately, that employee apparently failed to inform the proper authorities regarding the disturbing contents of the video. Any Missouri grandparent who faces similar legal challenges may seek assistance by contacting an experienced family law attorney in the area.
